HPP delighted to obtain planning permission for erection of new dwelling in Green Belt and outside settlement

HPP are delighted to have obtained planning permission for the erection of a dwelling on the site of a former stable block on behalf of clients Ranger Homes Ltd.

This was a particularly challenging case in that the site is located in the Green Belt and outside of any development boundary or settlement. Planning permission had been granted for the conversion of a stable block to two dwellings however when implementing the scheme, the original stable block collapsed and for health and safety reasons, the whole building was removed. As a consequence the applicant was unable to implement the approved scheme. Any new build on this site would be in direct conflict with the recently approved JCS.

In support of the client’s case, HPP identified case law which indicated that the site was brownfield and was able to convince the LPA that a “replacement dwelling” would have no greater impact upon the Green Belt than the originally approved two dwellings. Despite lengthy objections from the Parish Council, Officers supported HPP’s arguments that the recent grant of planning permission for the conversion of the former stable building to two residential buildings was a material consideration which would outweigh the conflict with the JCS. In granting permission for the original conversion, HPP highlighted the fact that the site was considered to be a sustainable location for residential development.
