Costs awarded and another appeal win for HPP
The main issue to be considered at this appeal was whether the proposal represented sustaina
ble development. On behalf of Bayhill Property Developments Ltd, HPP successfully argued that there is not a 5 year supply of housing land in Herefordshire. Furthermore, the Inspector accepted that the proposed density was in line with local policy, would not detract from the wider rural landscape and would not appear out of keeping with the scale and form of this part of the village. HPP also successfully argued that the site has a reasonable level of accessibility to a range of services and facilities.
With regard to the application for costs, the Inspector concluded that the LPA had failed to produce relevant, cogent evidence to substantiate their reason for refusal and as such awarded full costs.
